This Privacy Policy (“Policy”) describes the privacy practices of identID Health Corporation (“identID,” “we,” “us” or “our”), the ways we collect, use, and share your Personal Information when you visit our website and webpages (collectively, the “Service” or “Site”), as well as through social media, our marketing activities, and other activities described in this Privacy Policy. 

 

If you do not agree with our policies and practices, your choice is not to use our Site. By accessing or using our Site, you agree to this Privacy Policy. This Privacy Policy may change from time to time. Your continued use of our Site after we make changes is deemed to be acceptance of those changes, so please check this Privacy Policy periodically for updates.

 

This Policy applies to any visitors to our website and for users who create accounts with us through the website. This Policy does not represent the privacy practices of any third-party website or application that may collect information, link to or be accessible on or from the Service. 

 

identID Health provides management services to the Castillo Medical Office, P.C. (“Affiliated Medical Group”) and has a pharmacy arrangement with identID Corporation (“Pharmacy”). Consequently, identID may be deemed a “business associate” as defined under the Health Insurance Portability and Accountability Act (“HIPAA”) and subject to applicable requirements under HIPAA as it relates to the protection of your Personal Information that constitutes protected health information under HIPAA. You may share Personal Information with the Affiliated Medical Group and Pharmacy through this Site. If Affiliated Medical Group or Pharmacy operates as a covered entity, they are responsible under HIPAA for providing you with a Notice of Privacy Practices (NPP) describing their collection and use of your protected health information. Specifically, the NPP details your rights under HIPAA, such as the right to access or amend your PHI or request an accounting of disclosures. 

 

Additionally, any Personal Information that you provide through the Service may be subject to specific protections under other applicable laws, and identID Health may only use and disclose such information in accordance with such applicable laws.

 

  1. International Users; Use Outside the U.S. 

 

The Service is intended solely for users in the United States. Individuals outside of the United States should not use the Service. If you are outside the United States, information related to your use of our Service may be transferred, processed, or maintained outside your state and country, and may be subject to laws in your location that may have less stringent protections than in the United States. 

 

  1. Children’s Privacy.

 

Our Service is only intended for users 18 years of age and older. Our Service does not knowingly collect Personal Information of users who are under 18 years of age (“Minors”). We do not solicit or knowingly collect information from Minors, and if we become aware of any such information being collected, we will take immediate action to delete it. Personal Information you may provide us through the Service includes:

  • Transactional Data – such as information needed to complete your orders placed through the Service, including order numbers and transaction history. All financial and credit card information is directly processed and stored by our third-party service provider Tebra. 
  • Marketing Data – such as your preferences for receiving our marketing communications and details about your engagement with them. 
  • Medical Information – such as information including patient history and prescription drug information.

 

  1. Information We Obtain Indirectly; Cookies and Trackers.

 

We may collect information directly from you when you visit, access or use the Site or when you register an account with us. We may also collect information when you purchase any products available on our Site, submit information to use through a survey, communicate with us or post or submit content on or in the Site.

These service providers are not permitted to disclose, use or share any identifiable data except for with their subcontractors with whom they have data processing terms or to comply with legal processes, addressing functionalities to repair, or preventing security vulnerabilities.
  • Payment processors. Any payment card information you use to make a purchase on the Service is collected and processed by our contracted payment processor. 
  • Internet advertising partners. Third-party advertising companies for the interest-based advertising purposes described above.
  • Professional advisors. Professional advisors, such as lawyers, auditors, bankers and insurers, where necessary in the course of the professional services that they render to us.

The Service is not responsible for the availability or functionality of third-party platforms and cannot control or be held liable for their privacy practices or terms. Any issues related to the third-party platform must be addressed with the provider of that platform.

The Service may contain links to websites and other online services operated by contracted third parties. We do not control websites, mobile applications or online services operated by third parties, and we are not responsible for their actions. We’ve incorporated technical, organizational, and physical safeguards designed to protect the Personal Information we collect. However, security risk is inherent in all web-based and information technologies, and we cannot guarantee that hackers, cybercriminals, or other unauthorized third parties will not be able to get through our security, and improperly collect, access, steal, or modify your Personal Information. 

 

Sharing and disclosing information over the internet is not completely secure. Any transmission of Personal Information is at your own risk. We are not responsible for the circumvention of any privacy settings or security measures contained on our Service, in your operating system, or mobile device.
